Administrative Housing Tribunal (TAL)

Formerly the Régie du logement. The government body that handles all disputes between tenants and landlords in Québec.

Mandatory standard lease

In Québec, residential leases must use the official TAL form. A lease on a plain piece of paper without this form is not valid.

📌 Reference: art. 1895 C.C.Q. — The landlord must provide a signed copy of the lease within 10 days.

⚠️ Important for co-tenancy : In co-tenancy, each roommate should ideally be listed on the lease. If only one tenant is on the lease, the others are technically subtenants with fewer legal protections (art. 1870 C.C.Q.).

✅ What the landlord CAN do

  • Request a maximum of 1 month rent in advance — security deposits are prohibited in Québec

  • Increase rent once per year, with written notice within required timeframes

  • Refuse a sublease or lease assignment for a serious reason

  • Require a security deposit or post-dated cheques

💡 Tips before signing

Always visit the unit in person
Never sign a lease or make a payment without physically visiting the unit.

Do a move-in inspection
Take dated photos of every room before moving in. Email them to the landlord to have a written record.

Read the entire lease
Make sure you understand all clauses, especially those about pets, smoking, and repairs.

Beware of illegal deposits
In Québec, security deposits are PROHIBITED (art. 1904 C.C.Q.). If a landlord asks for one, it is illegal. Only the first month's rent can be required in advance.

A written agreement between roommates (expense sharing, chores) prevents many conflicts.
